2. What is offered
We provide software development and digital design services. The packages listed on this site are fixed-scope engagements: what each one includes and how long it takes is stated on its own page, and that description forms part of the contract. Work outside a listed package is agreed separately in writing.
3. Prices, currency and tax
- Prices are shown in euro (EUR) and include VAT. The figure shown is the amount charged.
- The applicable tax is determined on the payment page from your country of residence or establishment and, for business customers, from the VAT number you provide. Business customers established in another EU member state are normally settled under the reverse charge.
- The payment page may offer to charge you in your own currency instead of EUR. If you choose that option, the conversion rate and any conversion fee are shown to you before you confirm, and are set by the payment provider, not by us. Choosing EUR avoids the conversion entirely.
- Prices may change at any time, but never for an order already placed.
4. Placing an order
Selecting packages, entering your billing details and completing payment constitutes an offer to purchase. The contract is concluded when payment is confirmed and we send you the order confirmation. The order record shown after payment, and available to print, sets out what was bought.
5. Payment
Payment is taken on a secure page operated by our payment service provider, which acts as merchant of record for the transaction. That provider processes the payment, determines and settles the applicable tax, and issues the tax invoice for it. Card details are never transmitted to or stored on our systems.
6. Performance and timelines
- We contact you within one working day of a completed payment to schedule the work.
- The durations stated on each package page are working durations, counted from the day the agreed scheduling date is reached and all materials, access and information we asked for have been supplied.
- Where a package depends on your input — access to a system, content, a decision, a review — a delay on your side extends the delivery date by at least the length of the delay.
- The Support & Maintenance Retainer covers one calendar month, does not renew automatically, and hours not used within the month do not carry over.
7. What we need from you
You undertake to provide accurate billing details, to supply materials and access in a timely fashion, and to nominate one person able to make decisions on your behalf. You confirm that any content, data or credentials you hand over may lawfully be given to us for the purpose of the work.
8. Intellectual property
On full payment, the economic copyright in the source code and design deliverables produced specifically for you is transferred to you, on all fields of exploitation necessary to use, modify and further develop the work. Third-party components remain under their own licences, which are listed in the handover documentation. We retain the right to reuse general know-how, techniques and non-client-specific components.
9. Changes and cancellation
- Before work has started, an order may be cancelled for a full refund — write to us.
- Once work has started, the amount refundable is reduced by the work already performed, calculated proportionally to the deliverables completed.
- A change to an agreed scope is handled as a written change to the contract and, where it increases the effort involved, is priced separately.
10. Consumers and sole traders
Our services are addressed to businesses and organisations. If you nevertheless purchase as a consumer, or as a natural person running a sole proprietorship where the purchase is not of a professional character for you, you have the right to withdraw from a distance contract within 14 days without giving a reason, under the Polish Act on Consumer Rights of 30 May 2014. To do so, send an unambiguous statement to contact@zmeeva.eu.
If you ask us to begin performing the service before that 14-day period ends and we complete it at your express request, the right of withdrawal expires on completion. If performance has begun but is not complete, you pay a proportion of the price corresponding to the work done up to the moment of withdrawal. We will inform you of this before starting.
11. Complaints
If a deliverable does not match its description, tell us at contact@zmeeva.eu with a description of the problem. We acknowledge complaints within 3 working days and respond substantively within 14 days. Defects that are our responsibility are corrected at no charge.
12. Liability
We are liable for damage caused by our failure to exercise due care. Except in cases of wilful misconduct or where liability cannot be limited by law, our total liability arising out of a given order is limited to the amount paid for that order. We are not liable for indirect losses or lost profits.
We are not liable for delay or non-performance caused by events beyond our reasonable control, including failures of infrastructure, hosting or third-party services, provided we tell you promptly.
13. Data protection
Personal data is handled as described in our Privacy Policy. Where a project requires us to process personal data on your behalf, a separate data processing agreement under Article 28 of the GDPR is concluded before that processing begins.
14. Governing law and disputes
These terms are governed by Polish law. Disputes with business customers are submitted to the court having jurisdiction over our registered office. Nothing in this clause deprives a consumer of the protection of mandatory provisions of the law of their country of habitual residence, and consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
15. Current package prices
For the avoidance of doubt, the packages offered at the date shown above, VAT included:
